Description of the contract:

The Northern Region Development and Procurement Authority (NRDPA), Ghana has published its annual projects for 2025/2026, which include various products privately advertised through our consulting agencies. Interested suppliers, individuals, and companies are invited to express their interest in the selected products.

The Ghana Procurement Act applies to purchases, contracts for supplies, works, and the provision of services undertaken by the government, its ministries, and federal or state agencies. Section 25 of the Ghana Procurement Act provides for various procurement methods, including tenders, direct bidding, negotiation (mamarasa), competitive dialogue, competition, and others, and sets out the procedures to be followed for conducting procurement under each method.

PUBLIC PRIVATE PARTNERSHIP – AN ALTERNATIVE:

Apart from public procurement, public-private partnerships or PPP have been given strong impetus in the recent past. PPP is a contract between a government agency and private entity for performing a public project. The level of partnership between the entities generally depends on the project being developed. PPP could take the form of service contracts, management contracts, finance leasing contracts, concession contracts, BOT and BOOT contracts, etc. All PPPs are risk free-based partnerships with the nature & extent of risks depending on the project being undertaken. PPP contracts are typically on a long-term basis. PPP also attracts foreign investment and promotes economic growth of the country.

TERMS AND CONDITIONS OF PARTICIPATION:

Eligibility and Rules of Participation: All our tender supply projects are open to all legal persons participating either individually or in a group (consortium) of tenders, and foreign companies established in all countries or territories of the regions covered by or licensed by the specific instruments applicable to the program under which the contract is financed. All products supplied under the contract must be of good quality and compliant with the standard.

TEMA SEA-PORT OF GHANA:

The Republic of Ghana is a global hub for maritime trade, with several ports serving as key infrastructural destinations for trade. Ports and terminals have been developed in Ghana by the government and through partnerships with the private sector. Public-private partnerships are key for driving investments in the country, improving the quality of public services, reducing the burden of financial risks for the government and enabling the government to implement its projects efficiently.

SUPPLY DELIVERY DURATION:

The tender supply duration is 1 to 12 months after the Contractor/Supplier's confirmation of full payment and also partial shipment/delivery is allowed. Delivery duration can be extended to 1 - 18 months or more on request from the awarded supplier.

Agents:

Every tenderer and supplying companies must have a local agent as representatives.

SUBMISSION OF TENDER SUPPLY/BID DOCUMENT:

Tender Submission Procedures - Bids/Supply document must be submitted by hand to the Procurement Committee Board Secretary through any of our government accredited agent that will function as a local representative of the company throughout the tender supply bidding process.

CONTRACT SIGNING:

The contract agreement can be signed electronically i.e by email or by proxy but shall the Board request that the company appear in person, then such company should avail themselves at this invitation.

CONTRACT ACCEPTANCE:

The winning company will be required to sign a Contract Acceptance Letter upon receipt of the award notice and a signed, certified, and officially approved copy of the contract booklet.

PERFORMANCE GUARANTEE:

All contracts awarded by the Northern Region Development and Procurement Authority (NRDPA) are subject to a mandatory supply performance bond, which is signing a Performance Guarantee Declaration Letter document acknowledging the vendor's agreement to execute the supply of products required with good standard quality without any production and delivery issues.

The performance guarantee declaration letter must be submitted after receiving the signed and certified contract from the contracting authority no later than seven working days after the bidder receives the signed and certified contract from the contracting authority. If the selected bidder fails to submit this performance guarantee declaration letter within this period, the contract will be cancelled, and a new contract may be issued and sent to another bidder who was previously on the waiting list.

PAYMENT TERMS:

Each contract winner receives an 80% advance payment to begin production, with the remaining 20% due before shipment. The Northern Region Development and Procurement Authority (NRDPA) reserves the exclusive right to pay 100% of the total amount upfront, subject to the winning supplier's approval during contract invoice settlement.

MEETING AND SITE VISITING:

The Purchasing Council of Northern Region Development and Procurement Authority (NRDPA) may, at our discretion, send a delegation to the supplier company to inspect the production facility and current production levels, and hold a meeting there to verify product quality. In order for the contractor to be eligible to visit and meet with the Honourable Board Members in Ghana, only the winning supplier/contractor who wishes to attend for formal negotiations will be allowed to visit our office by appointment after the bid evaluation process, bid registration and formal award of the contract has been completed.

All written communications relating to the bidding and contract procedures must be in English language.

AGENT COMMISSION:

All our agents are entitled to an agreed negotiable commission (1 to 2% agency commission) of the total approved contract values, this commission is payable to the agent by the contracting supplier only after the supplier must have received and confirm contract invoice payment into their company bank account from the Northern Region Development & Procurement Authority (NRDPA) (the buyer).
